These Terms of Service ("Terms") constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Asheville Drywall (“Company,” “we,” “us,” or “our”) governing your access to and use of our services, including but not limited to drywall installation, repair, remodeling, consultation, and any related services offered by us through our website, phone, email, in person, or third-party platforms.
By engaging with our services in any form, including submitting a request, booking an appointment, or approving a proposal or estimate, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Service Eligibility
You must be at least 18 years of age and legally authorized to enter into binding contracts to request services from Asheville Drywall. By submitting a request or booking an appointment, you represent and warrant that all information you provide is accurate, current, and complete.
2. Scope of Services
Asheville Drywall provides drywall, painting, remodeling, and related services, subject to the scope outlined in the specific estimate or agreement provided to you. We reserve the right to refuse or cancel service for any reason, including unsafe working conditions, inaccurate information, or failure to comply with these Terms.
Any timeline or completion date provided is an estimate and may be subject to change due to weather, unforeseen site conditions, material availability, labor delays, or other factors beyond our control.
3. Scheduling, Rescheduling, and Cancellations
3.1 Client Cancellations
Cancellations must be submitted in writing at least 24 hours before the scheduled appointment time. Failure to cancel within this period may result in a cancellation fee.
3.2 Company Cancellations
We reserve the right to reschedule or cancel appointments for any reason, including inclement weather, safety concerns, illness, or material delays. Clients will be notified as soon as possible, and a new appointment will be arranged.
4. Estimates and Payments
All quotes and estimates are valid for 30 days unless otherwise specified in writing. Prices may vary based on job scope changes, material costs, or unforeseen circumstances.
Payment terms will be outlined in your written agreement or invoice. Asheville Drywall may require a deposit or staged payments based on project size. Late payments may incur interest at a rate permitted under North Carolina law.

Ensure access to the work area on the agreed dates

Notify us of any hazards or unusual conditions

Comply with all local codes, ordinances, and homeowner association rules
Failure to do so may result in delays, additional fees, or project cancellation.
6. Warranties and Limitations
We stand behind our workmanship. Unless otherwise stated in writing, Asheville Drywall offers a one-year limited warranty on labor. Material warranties are subject to the terms provided by the manufacturer.
This warranty does not cover:

Damage caused by misuse, negligence, or external factors

Repairs or alterations made by others

Normal wear and tear or cosmetic imperfections
We disclaim all other warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose, to the fullest extent permitted by law.
7. Limitation of Liability
To the maximum extent permitted by North Carolina law, Asheville Drywall shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, property damage, or business interruption, arising from the use or inability to use our services.
Our total liability shall not exceed the total amount paid by you for the specific project giving rise to the claim.
8. Intellectual Property
All content, designs, logos, and materials created by Asheville Drywall in connection with our website or marketing are our exclusive property. You may not reproduce, distribute, or modify any such materials without prior written consent.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Buncombe County, North Carolina.
10. Modifications
We reserve the right to modify these Terms at any time without prior notice. Updated Terms will be posted on our website, and continued use of our services constitutes acceptance of the modified Terms.
